The FY 2026 Impact Aid Discretionary Construction Grant Program is open under Assistance Listing 84.041C and opportunity number DOL-OESE-34832. The competition supports qualifying local educational agencies with emergency school-facility needs that pose health or safety hazards to students or school personnel.
Funding
The federal opportunity lists approximately $19 million in estimated total program funding, approximately four awards, and a published award range of $400,000 to $8,000,000. Applicants should apply the controlling notice and Impact Aid regulations when determining the actual federal share. Under 34 CFR 222.193, the general limitation is no more than 50 percent of an approved project cost and no more than $4 million in grant funds during a four-year period, except that those limitations do not apply to qualifying LEAs with no practical capacity to issue bonds. Section 222.191 also limits an award based on project cost and funds available from other sources.
Who may apply
For FY 2026, the Department of Education is accepting Priority One emergency applications only. An LEA is eligible if it has a school-facility emergency that poses a health or safety hazard to students or school personnel; enrolls at least 50 percent federally connected children who either reside on Indian lands or have a parent on active duty in the U.S. uniformed services, based on the LEA’s FY 2026 Impact Aid Section 7003 application; and meets at least one of these financial-capacity conditions: (1) taxable real-property assessed value below $25 million; (2) taxable real-property assessed value of at least $25 million but not more than $50 million and at least 75 percent of the LEA’s bond limit has been used; or (3) eligibility for heavily impacted district funds under Section 7003(b)(2) of the Impact Aid Act.
Eligible project focus
The program is intended for emergency repair, renovation, alteration, or replacement of school facilities used for free public education when emergency conditions threaten occupant health or safety. Accessibility improvements may be included as part of a larger qualifying project. Applicants must follow the controlling notice, application package, construction requirements, and all applicable federal rules.
Deadline and submission
Applications are due November 10, 2026 at 11:59:59 PM Eastern Time. The opportunity was posted September 8, 2026. Electronic submission is through Grants.gov, and applicants should confirm active federal registrations and review the current NOFO and application forms before submission.
Atlas assessment
Atlas Opportunity Score: 72/100. N9+ Fit Score: 35/100. This is a meaningful school-facility health and safety opportunity, but the competition is primarily for emergency construction and modernization. The Nonagon N9+ device and platform should not be assumed to be an eligible or material project component. Dr. Miltie, LLC is not an eligible direct applicant; any vendor or partner role would need to arise from a qualifying LEA’s approved project and applicable procurement rules.
