Opportunity Overview
The Utah Department of Health and Human Services is accepting applications under DHHS91172 from qualified providers to deliver services to DHHS clients, including people with Intellectual Disabilities, Related Conditions (ID.RC), and Acquired Brain Injury (ABI). The program supports home and community-based services focused on inclusion, integration, safety, and person-centered support.
Open-Ended Application Structure
DHHS91172 is an open-ended Invitation for Applications with no set closing date. DHHS evaluates applications as they are received and anticipates awarding perpetual contracts to all qualified providers. Contract award does not guarantee utilization or service volume.
Applications must be submitted by email only to kwilling@utah.gov with a subject line containing “IFA DHHS91172” and the provider business name. Applications must not be submitted through U3P. Provider questions are submitted through U3P, and posted answers or DHHS addenda may modify the requirements.
Pre-Solicitation Gate
Before submitting an application, a new provider must attend a DHHS Office of Service Review pre-solicitation meeting and successfully complete the required process, including HCBS Settings Rule training, an HCBS Settings Rule interview when applicable, review of policies, procedures and plans, and required DHHS licenses or certifications. Providers with a prior DHS90743 contract are exempt from this pre-solicitation requirement. Meeting invitations are requested from dhhsnewprovider@utah.gov using the DHHS91172 pre-solicitation meeting request subject specified by DHHS.
Services and Qualifications
The solicitation covers a broad range of disability and ABI services, including day supports, professional medication monitoring by LPN or RN, professional nursing services, professional parent supports, residential habilitation, respite, family and individual training, supported employment, supported living, companion, homemaker, personal assistance, personal budget assistance, and behavior consultation.
Qualifications are service-specific. Examples include current Utah DOPL nursing licenses for medication monitoring and nursing services, DHHS Office of Licensing credentials for specified day, foster, and residential services, education and experience requirements for family training, ACRE and other employment-services training for supported employment categories, and BACB/DOPL credentials or other qualifying pathways for behavior consultation.
Medicaid and Operational Requirements
The scope requires the contractor to be an approved Medicaid provider for the Community Support Waiver, Community Transition Waiver, and Acquired Brain Injury Waiver; maintain active USTEPS and UPI access; and maintain all applicable licenses and certifications. The contract also contains extensive staff training, background screening, documentation, HIPAA, health and safety, incident reporting, HCBS Settings Rule, and person-centered service requirements.
A provider may not simultaneously hold a DHHS91172 contract and a DHHS Support Coordination External contract.
Required Application Materials
The application package includes the DHHS Data Sheet, Conflict of Interest Disclosure Statement, W-9 completed in the applicant’s legal name and signed within six months of submission, Service Application Form with all required qualification evidence, Business Associate Agreement, and Medicaid Enrollment Documentation. Applicants requesting protection of business-confidential information must follow DHHS instructions for a confidentiality claim and provide a properly redacted public copy.
Rates and Funding
Providers must not submit pricing. DHHS uses established service rates, which may change based on legislative appropriations or DHHS budget action. Current examples include Professional Medication Monitoring by LPN at $8.45 per quarter hour, Professional Medication Monitoring by RN at $12.22 per quarter hour, Professional Nursing Service I at $42.35 per day, Professional Nursing Service II at $119.49 per day or $29.87 per session, and other service-specific rates. Some worksheet-based services list maximum rates while actual payment may be lower and individually negotiated. DHHS does not state an overall funding pool, universal contract ceiling, or guaranteed utilization.
Atlas Strategic Analysis
Atlas Opportunity Score: 86/100. DHHS91172 is a durable statewide contracting pathway with rolling evaluation, broad service coverage, and potential awards to all qualified providers. The opportunity also carries substantial qualification, Medicaid, licensing, operational, and compliance requirements and has a mature incumbent provider base.
N9+ Fit Score: 10/100. The procurement is fundamentally for licensed and qualified human services, not medical-device or telehealth technology acquisition. A Nonagon N9+ remote physical examination platform could only be ancillary to an independently compliant provider workflow if DHHS permits that use; Atlas does not assume the device is reimbursable or substitutes for required staff, licensure, Medicaid enrollment, or service delivery. Dr. Miltie direct pursuit is therefore classified as No Bid unless all provider qualifications and delivery infrastructure can be independently verified.
Next Action
Qualified Utah disability-service providers should first complete the required Office of Service Review pre-solicitation process unless exempt, select only service categories for which they can document every qualification, confirm Medicaid waiver enrollment and USTEPS/UPI readiness, review current U3P questions and answers and DHHS addenda, and submit the complete application package by email according to DHHS instructions.
